Michigan Supreme Court to hear case about Harbor Shores
« on: December 16, 2010, 01:39:37 PM »
"The Michigan Supreme Court has agreed to hear an appeal of a lawsuit that seeks to remove 3 holes of The Golf Club at Harbor Shores from Jean Klock Park along Lake Michigan.  The major issue is whether the city's decision in 2004 to lease part of the city-owned park to Harbor Shores violated the original deed when the Klock family gifted the park to the city in 1917."

that's all i know...

The oral argument is set for January.  The defendants have heavy hitters as counsel (former Detroit mayor, Dennis Archer).

The main question, from my brief looking at it is whether a public golf course is considered a "public purpose" or a "park purpose" as the granting deed restricts.
I get it, you are mad at the world because you are an adult caddie and few people take you seriously.

Excellent spellers usually lack any vision or common sense.

I know plenty of courses that are in the red, and they are killing it.

Im not sure.  I don't know any specifics of the project, the area nor the litigation.

I believe the answer to that is yes as the subject plot of land was previously a public park.

Yes that beach is public.

On the other side of the holes/dunes is the beach, a parking lot, a few widow's watches, etc... There are only golf holes on the west side of the dunes, but even still alot of the land in between the holes can be used by the public to walk/ride bikes/picnic, etc...
